sir if their is a change in the management due to insolvency of the 2 or 3 directors and after that there is likely that the affairs of the company will be counducted prejudical ....so can the menbers still apply in the nclt ? .... and what will be the form no. for filing the application to nclt ?... will the members will fill that application directly or they will give it to the company secretary of that company and company secretary will file ?.......... thank you sir

  4. Sec. 241 - Application to Tribunal for Relief in Cases of Oppression, etc


  5. 1) Any member of a company who complains that- (a) The affairs of the company have been or ar being conducted in a manner prejudicial to publ interest or in a manner prejudicial on @prssiveto him or any other member or members or in a manner prejudicial to the interests of the company or


  6. (b) The material change, not being a chang about by, or in the interests of, any creditdrs, includin debenture holders or any class of shareholders of 1 company, has taken place in the management or contro of the company, whether by an alteration in the Board of Directors, or manager; or in the ownersh company's shares, ught the


  7. or if it has no share capital, in its membershin, or in any other manner whatsoever; a reason of such change, it is likely thdi the affairs of the company will be conducted in a manner prejudicial to its interests or its members or any class of members, may apply to the Tribunal, provid such member has a right to apply mder section fer an order under this Chapter. nal a
